Welcome to D. Millz 3D Works. By accessing our website, placing an order, requesting a quote, or purchasing products or services from us, you agree to these Terms and Conditions.
## 1. General
D. Millz 3D Works provides custom and personalized products including, but not limited to, tumblers, license plates, apparel, gifts, promotional products, and other custom merchandise.
We reserve the right to update, modify, or replace these Terms and Conditions at any time without prior notice.
## 2. Orders
All orders are subject to acceptance and product availability.
We reserve the right to refuse or cancel any order at our sole discretion, including orders containing unlawful, offensive, infringing, or inappropriate content.
Prices, product descriptions, and availability are subject to change without notice.
## 3. Custom and Personalized Products
Due to the nature of custom products, customers are responsible for reviewing all submitted information before approving production.
This includes but is not limited to names, dates, spelling, artwork, colors, layouts, and personalization details.
Once production has begun, changes may not be possible.
D. Millz 3D Works is not responsible for errors approved by the customer prior to production.
## 4. Customer Supplied Artwork and Intellectual Property
By submitting any artwork, photographs, logos, trademarks, designs, graphics, text, or other content, the customer represents and warrants that they possess all necessary rights, permissions, licenses, and authorizations required for reproduction of the submitted materials.
Customers agree that:
* They own the submitted content or have permission to use it.
* The submitted content does not infringe upon any copyright, trademark, patent, publicity right, privacy right, or other intellectual property right.
* They assume full responsibility for the submitted content.
D. Millz 3D Works reserves the right to refuse any order that may violate intellectual property rights or applicable laws.
Customers agree to indemnify, defend, and hold harmless D. Millz 3D Works, its owners, employees, and representatives from any claims, damages, liabilities, costs, expenses, or legal fees arising from the customer's submitted content.
## 5. Product Appearance
Colors displayed on computer monitors, tablets, and mobile devices may differ from the final product.
Minor variations in color, placement, sizing, texture, and appearance may occur due to manufacturing processes and shall not be considered defects.
## 6. Production Times
Production times vary depending on product type, customization requirements, order volume, material availability, and shipping conditions.
Estimated production and delivery dates are estimates only and are not guaranteed.
D. Millz 3D Works is not responsible for delays caused by shipping carriers, weather, supply shortages, equipment failures, or other circumstances beyond our control.
## 7. Shipping
Customers are responsible for providing accurate shipping information.
D. Millz 3D Works is not responsible for delays, loss, theft, or damage occurring after packages have been transferred to the shipping carrier.
Customers may be responsible for additional shipping charges resulting from incorrect or incomplete addresses.
## 8. Returns, Refunds, and Exchanges
Custom and personalized products are generally non-refundable and non-returnable unless:
* The product contains a manufacturing defect; or
* The product differs materially from the approved design.
Claims regarding defects or production errors must be reported within seven (7) days of delivery.
Photographs may be required to process any claim.
Non-custom products may be eligible for return or exchange at our discretion.
## 9. Limitation of Liability
To the fullest extent permitted by law, D. Millz 3D Works shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from the use of our products or services.
Our total liability for any claim shall not exceed the amount paid by the customer for the product giving rise to the claim.
## 10. Website Content
All website content, including but not limited to logos, graphics, product photographs, text, branding, and original artwork, is the property of D. Millz 3D Works unless otherwise noted and may not be copied, reproduced, or distributed without written permission.
## 11. Governing Law
These Terms and Conditions shall be governed by the laws of the State of Ohio without regard to conflict of law principles.
Any disputes arising from these Terms and Conditions shall be resolved in a court of competent jurisdiction located within the State of Ohio.
